Article 69

Identification

1 - Residential Spaces on urbanizable land shall consist of areas predominantly intended for housing functions which, not yet having the characteristics of urbanized space, are expected to acquire them.

2 - The urbanizable residential spaces are divided into:

a) Urbanizable residential spaces type I, which correspond to areas that are intended to acquire urban characteristics, predominantly housing, of medium/low density and volume;

b) Urbanized residential spaces type II, which correspond to areas that are intended to acquire urban characteristics, predominantly housing of greater density and volumetry.

Article 70 Occupations and uses

1 - Generic objectives for these spaces are a phased and planned urban occupation in order to ensure an efficient and sustainable use of urban infrastructures, the provision of quality public spaces and the creation of pedestrian and road circulation networks correctly dimensioned.

2-these spaces are intended for housing, commerce, services, equipment and green spaces for collective use, public and private, tourism, industrial establishments and other activities compatible with the dominant use, in particular with housing use.

3-the occupation of these spaces is processed by the approval of detail plans, allotment operations or execution units.

4-the City Council may authorize individual urban operations provided that the following conditions are guaranteed:

a) The proposed solutions ensure a correct formal and functional articulation with the urbanized spaces and do not harm the urban planning of the urbanizable area in which it is inserted, in particular, with regard to the design and layout of streets and other urban infrastructures;

b) The building object of the urban operation is contiguous to the urbanized space or contiguous to areas that have acquired characteristics similar to this through urbanization or building actions;

5-the provisions of the preceding paragraph may also apply to buildings that do not comply with the situation referred to, provided that the City Council considers that the appropriate functional articulation with the urbanized space is ensured.

6-is allowed the expansion of industrial establishments of type 3, aiming at the improvement of environmental, hygiene and safety conditions, as well as the change of typology, provided that are not created situations of incompatibility of uses and that are not polluting in terms to be defined in municipal regulations.

Article 71

Building regime

1 - In the absence of an urbanization plan, a detailed plan or a subdivision permit, urban operations in urbanizable residential spaces shall be subject to the following parameters:

2 - Os Espaços residenciais urbanizáveis dividem-se em:

a) Espaços residenciais urbanizáveis tipo I, que correspondem a áreas que se pretende que venham a adquirir características urbanas, predominantemente habitacionais, de densidade e volumetria médias/baixas;

b) Espaços residenciais urbanizados tipo II, que correspondem a áreas que se pretende que venham a adquirir características urbanas, predominantemente habitacionais de maior densidade e volumetria.

Artigo 70.º Ocupações e utilizações

1 - São objetivos genéricos para estes espaços uma ocupação urbana faseada e planeada por forma a garantir um aproveitamento eficiente e sustentável das infraestruturas urbanas, a dotação de espaços públicos de qualidade e a criação de redes de circulação pedonal e viária corretamente dimensionadas.

2 - Estes espaços destinam-se a habitação, comércio, serviços, equipamentos e espaços verdes de utilização coletiva, públicos e privados, turismo, estabelecimentos industriais e outras atividades compatíveis com o uso dominante, designadamente com o uso habitacional.

3 - A ocupação destes espaços processa-se mediante a aprovação de planos de pormenor, operações de loteamento ou unidades de execução.

4 - A Câmara Municipal pode autorizar operações urbanísticas avulsas desde que sejam garantidas as seguintes condições:

a) As soluções propostas assegurem uma correta articulação formal e funcional com os espaços urbanizados e não prejudiquem o ordenamento urbanístico da área urbanizável em que se insere, em particular, no que respeita ao dimensionamento e traçado de arruamentos e outras infraestruturas urbanísticas;

b) O prédio objeto da operação urbanística seja contiguo ao espaço urbanizado ou contíguo a áreas que tenham adquirido características semelhantes a este através de ações de urbanização ou edificação;

5 - O disposto no número anterior pode ainda aplicar-se a prédios que não cumpram a situação referida, desde que a Câmara Municipal considere que fica assegurada a adequada articulação funcional com o espaço urbanizado.

6 - É permitida a ampliação de estabelecimentos industriais de tipo 3, visando a melhoria das condições ambientais, de higiene e segurança, assim como a alteração de tipologia, desde que não sejam criadas situações de incompatibilidade de usos e que não sejam poluentes em termos a definir em regulamentos municipais.

Artigo 71.º

Regime de edificabilidade

1 - Na ausência de plano de urbanização, plano de pormenor ou alvará de loteamento as operações urbanísticas nos espaços residenciais urbanizáveis ficam sujeitas aos seguintes parâmetros:

2 - Para a construção nova ou ampliação de edifícios isolados de habitação unifamiliar ou bifamiliar tem de ser garantido um afastamento mínimo de 3 m às estremas do lote ou parcela, ou de 5 m quando existam fachadas com vãos de iluminação de compartimentos habitáveis.
